Terms and Conditions

1. Acceptance of Terms

By accessing the Pure Roofing website or engaging our services, you (the “Client”) agree to be bound by these Terms and Conditions. These terms govern all estimates, contracts, and services provided by Pure Roofing. Any modifications to these terms must be agreed upon in writing by an authorized representative of Pure Roofing.

2. Scope of Work and Structural Integrity

• Decking and Structure: The Client warrants that the roof deck and supporting structures are sound and capable of supporting standard roofing operations, including the weight of equipment and materials.
• Visual Inspection: Pure Roofing’s initial estimate is based on a visual inspection of observable conditions. We are not responsible for structural deficiencies, moisture content in the substrate, or construction defects performed by previous contractors that are hidden from view.
• Interior Protection: Roofing is a vibrating process. The Client is responsible for removing or protecting fragile interior items (such as chandeliers, wall art, or attic storage) that could be dislodged during the installation process.

3. Payment Terms and Financial Policy

• Deposit: Unless otherwise stated in your specific project contract, a down payment is typically required upon execution of the agreement to secure your place on our schedule.
• Final Payment: The remaining balance, including any approved change orders for rotted wood or hidden damage, is due immediately upon substantial completion of the work.
• Late Fees: Past-due accounts are subject to interest charges as permitted by Kentucky law (typically 1.5% per month).
• Processing Fees: Payments made via credit card may be subject to a standard processing fee (usually 2-3%).

4. Concealed Damages and Change Orders

Because it is impossible to see every layer of a roof before tear-off, unforeseen conditions may arise (e.g., rotted plywood, mold, or deteriorated flashing).

• Extra Work: Replacement of rotted decking or wet insulation is considered “Extra Work” and will be billed at the unit prices outlined in your estimate.
• Notification: Pure Roofing will notify the Client of such conditions as soon as they are discovered.

5. Scheduling, Delays, and Weather

• Guidance Only: Any start or completion dates provided are estimates.
• Force Majeure: Pure Roofing is not liable for delays caused by circumstances beyond our control, including severe Kentucky weather, material shortages, labor strikes, or acts of God. Such delays do not constitute a breach of contract.

6. Safety and Site Conditions

• Access: The Client shall provide clear and safe access to the driveway and roof area. Vehicles should be moved at least 30 feet away from the work zone to prevent damage from falling debris.
• Electrical Hazards: The Client warrants that the roof area is free of live, unconcealed electrical hazards.
• HVAC and Fumes: Roofing processes may emit odors or dust. The Client is responsible for managing their HVAC intake systems if they are sensitive to such occurrences.

7. Licensing and Insurance

Pure Roofing maintains all necessary licenses required by Louisville Metro and the Commonwealth of Kentucky. We carry high-limit General Liability and Workers’ Compensation insurance. Upon request, we can provide a Certificate of Insurance (COI) naming the Client as an additional insured for specific commercial projects.

8. Limited Warranty and Liability

• Workmanship: Pure Roofing provides a standard workmanship warranty as specified in your contract. This warranty covers the labor and installation of the roofing system.
• Materials: Material warranties are provided solely by the manufacturer (e.g., GAF, Owens Corning).
• Exclusions: Our warranty does not cover damage caused by lightning, gale-force winds (exceeding shingle ratings), hailstorms, or structural movement of the building. We are not liable for consequential or incidental damages to the interior of the building unless caused by direct negligence.

9. Media and Marketing

The Client grants Pure Roofing permission to take photographs and videos of the project during and after completion. We reserve the right to use these images for our website, social media, and advertising materials. No personal or sensitive financial information will ever be included in these promotional materials.

10. Dispute Resolution and Governing Law

These Terms and Conditions shall be governed by the laws of the Commonwealth of Kentucky. Any disputes arising from this agreement shall first be attempted to be resolved through informal negotiation. If a resolution cannot be reached, the parties agree to seek mediation in Jefferson County, KY.

11. Right to Stop Work

Pure Roofing reserves the right to stop work if payments are not made according to the agreed-upon schedule or if site conditions become unsafe for our crews.
